Hitchit Trailer Hire – Terms & Conditions

1. Introduction

1.1 Rental Agreement
By hiring a trailer from Hitchit, you agree to these Terms & Conditions, our Privacy Policy, and the signed Hire Agreement (collectively, the “Rental Agreement”).

1.2 Jurisdiction
These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in Queensland courts.

1.3 Australian Consumer Law
Nothing in these Terms excludes your rights under Australian Consumer Law.

2. Eligibility

2.1 Drivers
Only drivers aged 25–75 with at least 12 months of valid, unrestricted Australian driver’s licence may tow Hitchit trailers. Learner, probationary, or inexperienced drivers are not permitted without prior written approval.

2.2 Responsibility
You are responsible for anyone who tows the trailer under your hire, and liable for any damage, loss, theft, or legal breach they cause.

3. Trailer Use

3.1 You Must Not:

  • Tow under the influence of drugs or alcohol.

  • Overload or improperly load the trailer.

  • Tow on unsealed roads, beaches, rivers, or other off-road locations.

  • Use a vehicle not rated to tow the trailer’s weight/load.

  • Tow if the trailer is damaged, unroadworthy, or unsafe.

  • Sub-hire or allow others to use the trailer without prior written consent.

3.2 Towing Requirements
You must:

  • Check all lights, chains, tyres, and connections before departure.

  • Ensure loads are properly secured and safely distributed.

4. Trailer Condition, Theft & Damage

4.1 Pre-Hire Inspection
You agree to inspect the trailer before departure and report any existing damage.

4.2 Damage Liability
You are responsible for any loss, theft, or damage to the trailer or its components (including tyres, lights, and accessories) during the hire period.

4.3 Theft by Hirer
If the trailer is not returned and we are unable to contact you within 24 hours of the return time, we may consider the trailer stolen and report it to police. A minimum $1,000 excess applies for any loss or theft caused by a hirer under our insurance policy.

5. Accidents, Breakdowns & Repairs

5.1 Accidents
If an accident occurs, you must:

  • Contact us within 24 hours.

  • Take photos of damage and accident scene.

  • Exchange driver and vehicle details.

  • Report to police if necessary.

  • Not admit fault or arrange repairs without written consent.

5.2 Breakdowns
If the trailer becomes faulty or unsafe, stop use immediately and notify us. Continued use may increase your liability.

6. Returns, Extensions & Late Fees

6.1 Return Policy
Trailers must be returned on time, clean, and in the same condition. Late returns incur a 50% hourly surcharge, or $100 per day after 24 hours.

6.2 Failure to Return
If the trailer is not returned within 24 hours of the agreed time and we are unable to reach you, it will be deemed stolen and may be reported to police.

6.3 Extensions
If you need additional time, contact us prior to your scheduled return. Extensions are subject to availability and may incur additional charges.

7. Cancellations

  • Cancellations made more than 12 hours before the booking start time will receive a full refund.
    Cancellations made within 12 hours of the booking start time will receive a 50% refund.
    No refund will be given once the hire period has commenced.

8. Damage Waiver & Insurance

8.1 Damage Waiver
A damage waiver will be included in your hire fee. This waiver reduces your financial liability in the event of accidental damage (but not theft, misuse, or negligence).

8.2 Insurance & Excess
Insurance is included in your hire. However, in the event of a claim, you may be required to pay an excess.

9. Miscellaneous

9.1 Personal Items
We are not liable for loss, theft, or damage to any personal items stored in or on the trailer.

9.2 Indemnity
You agree to indemnify Hitchit for any damage, legal costs, or third-party claims arising from breach of these Terms or misuse of the trailer.

9.3 Privacy
We collect your personal information solely for hire and insurance purposes. Your information will not be shared without your consent, except where legally required.
